Terms of Use and Purchase
Please read these terms carefully before using the service.

These terms of use and purchase apply to the use of the Elämyskauppa.fi online service and to gift cards purchased through the Service. The Service is maintained by Suomen elämykset Oy, Business ID 3612111-1, hereinafter "Elämyskauppa". Gift cards may be purchased by consumers, companies and other organisations. By using the Service or placing an order, the customer accepts these terms as well as any gift card and service-specific terms communicated before the order. These terms do not limit the rights of consumers under mandatory legislation.
2. Definitions
In these terms: • Service refers to the Elämyskauppa.fi online service and its related functions. • Elämyskauppa refers to Suomen elämykset Oy, which operates the Service, sells and manages gift cards, and acts as an intermediary for the services of Experience Providers. • Experience Provider refers to a named business or entrepreneur in the Service that sells and delivers the experience, service or product covered by a gift card. • Customer refers to a consumer, company or other organisation that purchases a gift card, and where applicable, the user of the gift card. • Consumer Customer refers to a natural person who makes a purchase primarily for purposes other than their trade or professional activity. • Business Customer refers to a company, organisation or person who makes a purchase for their trade or professional activity. • Gift Card refers to a digital or physical gift card, code or other identifier that entitles the holder to use the service or monetary value specified therein in accordance with the terms.
3. Role of Elämyskauppa and the Experience Provider
Elämyskauppa acts as a sales, intermediary and redemption platform for gift cards. Elämyskauppa receives the customer's payment, delivers the gift card and manages functions related to using, exchanging and returning gift cards. Elämyskauppa is not liable for damages caused by the Experience Provider's actions, negligence, personnel, equipment or delivery of the experience. The experience or other service covered by the gift card is delivered by the named Experience Provider in the Service. When a customer books or orders a specific experience on the basis of a gift card, a contractual relationship regarding the delivery of the service is formed between the customer and the relevant Experience Provider. The Experience Provider is responsible for, among other things: • the content and delivery of the experience or service; • the quality and safety of the service; • its personnel and equipment; • the necessary permits, qualifications and insurance; • the accuracy of service, pricing and availability information it provides; • errors, delays and non-delivery of the service. Elämyskauppa is responsible for its own operations, including: • maintaining the Service and the gift card system; • processing orders and payments; • delivering gift cards; • the accuracy of information provided by Elämyskauppa itself; • handling requests related to exchanging and returning gift cards. The name of the Experience Provider is stated in the experience description or, at the latest, in the order confirmation delivered to the customer.
4. Purchasing a Gift Card
Gift cards are purchased using the payment methods available in the Service at any given time. The total price of the order, any delivery charges and other mandatory fees are communicated to the customer before the order is confirmed. An external payment service provider may be used for technical payment processing. Payment information is handled in accordance with that provider's terms and privacy practices. The customer is responsible for the accuracy of the name, email address, postal address and other information they provide. Elämyskauppa has the right to reject or cancel an order if there is reasonable cause to suspect payment fraud, misuse, incorrect information or other unlawful activity. If a paid order is cancelled by Elämyskauppa and the gift card is not delivered or used, the amount paid by the customer will be refunded unless there is a legal basis for retaining the payment.
5. Gift Card Delivery and Loss
A digital gift card is delivered to the email address provided by the customer. A physical gift card is delivered to the postal address provided by the customer using the selected delivery method. The customer is responsible for the careful safekeeping of the gift card after it has been delivered to the customer or the recipient they have specified. Elämyskauppa is not liable for the loss, damage or theft of a physical gift card after delivery to the customer. If a physical gift card is lost before it is used, the customer must notify Elämyskauppa of the loss as soon as possible. Elämyskauppa may cancel the lost gift card and issue a replacement digital gift card if: • the purchase of the gift card can be reliably verified; • the gift card can be individually identified; • the gift card has not been fully or partially used; • the gift card can be technically cancelled; • the customer's account is credible; and • there is no reasonable cause to suspect misuse. Elämyskauppa has the right to request a proof of purchase and other reasonable documentation from the customer before issuing a replacement gift card. A lost gift card will not be replaced if it has already been used or cannot be reliably identified and cancelled. A replacement gift card will primarily be issued digitally. A delivery fee in accordance with the current price list may be charged for issuing a new physical gift card.
6. Gift Card Validity and Value
Unless otherwise stated before purchase in connection with the gift card, the gift card is valid for 730 days from the date of purchase. The gift card must be used, or a booking based on it must be made, within the gift card's validity period. The experience may take place after the gift card's validity period has ended, provided the booking was made during the validity period and the Experience Provider accepts the booking. A service-specific gift card entitles the holder to the named service without any surcharge due to price increases for the first 365 days from the date of purchase. If a gift card is used more than 365 days after the date of purchase and the price of the service has increased, the customer pays the difference between the amount paid for the gift card and the new price of the service. For example, if €80 was paid for the gift card and the service is later priced at €90, the customer will pay €10. The monetary value originally paid for the gift card is retained throughout the gift card's validity period. After the validity period has expired, an unused gift card cannot be used and its value will not be refunded, unless mandatory legislation, prevention of service delivery or a separately agreed reason requires otherwise.
7. Exchanging a Gift Card
An unused gift card may be exchanged for another gift card available in the Service during its validity period, unless the gift card has been marked as non-exchangeable before purchase. No separate handling fee is charged for an exchange. If the new experience is more expensive than the original gift card, the customer pays the difference. If the new experience is less expensive than the original gift card, the remaining value is converted into an open gift card within Elämyskauppa, available to the customer until the end of the original gift card's validity period. Exchanging a gift card does not extend its original validity period. When a gift card is exchanged, the original gift card is cancelled and the customer is issued a new digital gift card or other access identifier. If the customer wishes to receive a new physical gift card after the exchange, a delivery fee in accordance with the current price list may be charged.
8. Ordering, Booking and Using an Experience
The gift card is used in accordance with the instructions provided in the gift card, the experience description or the order confirmation. The experience is ordered or booked either through Elämyskauppa or directly with the Experience Provider in accordance with service-specific instructions. When a customer orders or books an experience covered by a gift card, the delivery of the experience is governed primarily by the service, booking and cancellation terms of the relevant Experience Provider. The key terms of the Experience Provider are made available to the customer before the experience is ordered or booked. The gift card does not guarantee availability on a specific date or at a specific time unless separately agreed. If the customer fails to attend the booked experience or cancels after the deadline stated by the Experience Provider, the gift card may be considered fully used.
9. 30-Day Return Right for Gift Cards
All customers, including consumer and business customers, have the right to return an unused gift card within 30 days of the date of purchase. No specific reason is required to exercise the return right. The return right applies only to gift cards that have not been fully or partially used. A gift card is considered used if: • the gift card or part of its value has been redeemed; • the experience or service based on the gift card has been delivered; • there is an active service booking based on the gift card; • the benefit or discount offered by the gift card has been used; or • the gift card has otherwise been used in a manner that cannot be reversed. Merely exchanging a gift card for another unused gift card does not remove the return right. However, the return period is calculated from the date of purchase of the original gift card. If a booking made on the basis of a gift card is cancelled in accordance with the Experience Provider's booking and cancellation terms and the full value of the gift card is restored for use, the gift card is not considered used solely on account of the cancelled booking. The return request must be submitted to Elämyskauppa within 30 days of the date of purchase. The return request must include the order reference details and any other information reasonably required to process the return. The return right is exercised primarily by the purchaser of the gift card. If the return is requested by the gift card recipient, Elämyskauppa has the right to request the purchaser's consent or other reliable evidence of the right to return. When the conditions for a return are met, the gift card is cancelled and the amount paid for the gift card is refunded to the original payment method without undue delay and within 14 days of receiving the necessary information. If a refund to the original payment method is not technically possible, the refund may be paid to a bank account provided by the customer. This 30-day return right does not limit the rights of consumer customers under mandatory legislation.
10. Cancellation or Prevention of an Experience
The Experience Provider may need to change or postpone the date of an experience due to reasons related to safety, weather conditions, personnel, equipment or a regulatory requirement. The Experience Provider must notify the customer of any material change without undue delay and offer, where possible, a new reasonable date. If the experience cannot be delivered as agreed or within a reasonable time, the customer may be offered, depending on the circumstances: • rescheduling the experience to a new date; • an equivalent replacement experience; • exchange of the gift card for another experience. If payment has already been settled to the Experience Provider and the grounds for a refund arise from the Experience Provider's actions, cancellation of the service, an error or non-delivery, the Experience Provider is responsible for the refund and its costs. Elämyskauppa may in such cases process the refund request, forward it to the Experience Provider or pay the refund to the customer on behalf of the Experience Provider. Elämyskauppa is not liable from its own funds for refunding a payment already settled to the Experience Provider if the grounds for the refund arise from the Experience Provider, unless mandatory legislation requires otherwise. If the Experience Provider ceases operations, becomes insolvent or is declared bankrupt, Elämyskauppa will refund the customer to the extent that the relevant payment is still held by Elämyskauppa. If payment has already been settled to the Experience Provider, responsibility for the refund lies primarily with the Experience Provider or its bankruptcy estate. Elämyskauppa will where possible assist the customer in resolving the matter.
11. Defects and Complaints
Complaints regarding the content, quality, safety, delay or delivery of an experience should be addressed in the first instance to the Experience Provider that delivered the experience. The customer may also submit a complaint to Elämyskauppa. Elämyskauppa may forward the complaint to the Experience Provider and assist in resolving the matter. A complaint must be made within a reasonable time of the customer discovering, or when they should have discovered, the defect. Mere customer dissatisfaction with the service or the customer's subjective experience thereof does not entitle the customer to a price reduction, monetary refund or other compensation, if the experience has been delivered as agreed and corresponded to the information and terms provided at the time of purchase. A complaint alone does not mean that the service is defective, nor does it automatically prevent settlement to the Experience Provider. If, however, there is reasonable cause based on the complaint to suspect a defect, cancellation, non-delivery or other matter that may affect the amount to be settled to the Experience Provider, Elämyskauppa may withhold the amount in question or the necessary portion thereof pending resolution of the matter. Elämyskauppa is liable for defects and direct damages arising from its own actions or negligence. Elämyskauppa is not liable for the content, quality, safety or damages arising from a service delivered by an Experience Provider, unless the damage results from Elämyskauppa's own actions or responsibility. In relation to Business Customers, Elämyskauppa is not liable for indirect damages, lost profit, turnover or other business losses, unless the damage was caused intentionally or through gross negligence.
12. Gift Card Security
The gift card and its code are identifiers similar to a means of payment. The customer is responsible for their careful safekeeping. The customer must not publish the gift card code or share it with a person to whom they do not wish to grant access to the gift card. The first properly executed redemption is considered valid use of the gift card. Elämyskauppa is not liable for unauthorised use resulting from the customer's negligence, voluntary disclosure of the gift card code or public sharing of the gift card. This does not remove the liability of Elämyskauppa or the Experience Provider if the unauthorised use results from a deficiency in their systems, a data security breach or another reason within their responsibility.
13. Technical Operation of the Service and Force Majeure
Elämyskauppa aims to keep the Service available and to resolve technical disruptions within a reasonable time. The Service may be temporarily interrupted for reasons such as maintenance, a technical fault, a security threat, a regulatory requirement or another justified reason. Elämyskauppa is not liable for disruptions or delays caused by obstacles beyond Elämyskauppa's reasonable control. Such obstacles may include, for example, a widespread communication network failure, power outage, natural phenomenon, industrial action, epidemic, regulatory order or a serious disruption caused by a third-party service provider. If a technical disruption within Elämyskauppa's responsibility prevents the use of a gift card during its validity period, Elämyskauppa may reasonably extend the gift card's validity period or arrange another solution corresponding to the customer's rights. Elämyskauppa has the right to modify, suspend or discontinue the Service or parts of it. Discontinuation of the Service does not remove rights relating to a gift card already purchased by the customer.
14. Customer Obligations and Prohibited Use
The customer undertakes to use the Service in accordance with the law, good practice and these terms. The customer must not: • use the Service for fraudulent or unlawful purposes; • copy, forge or alter a gift card or its identifier; • attempt to use the same gift card multiple times; • disrupt the technical operation of the Service; • attempt to circumvent the Service's security or authentication systems; • intentionally provide false information; • use the Service in a manner that causes harm to Elämyskauppa, the Experience Provider or other users. Elämyskauppa has the right to block the use of a gift card or user account associated with misuse for the duration of the investigation.
15. Intellectual Property Rights
The software, appearance, texts, images, logos, trademarks and other materials of the Service belong to Elämyskauppa, the Experience Providers or other rights holders. The content of the Service may not be copied, published, sold, modified or used commercially without the permission of the rights holder, unless use is permitted by law.
16. Processing of Personal Data
Elämyskauppa processes personal data in accordance with applicable data protection legislation and the privacy policy published in the Service. Customer data necessary for delivering an experience may be shared with the Experience Provider for purposes such as confirming a booking, identifying the customer, delivering the service and handling complaints.
